EU AI Act

EU regulation governing AI systems through a risk-based approach, particularly relevant for recruiting and HR.

The EU AI Act is the central European regulation for artificial intelligence. It follows a risk-based approach: certain applications are forbidden, high-risk applications must satisfy extensive duties, other systems face only transparency obligations or remain largely unregulated.

AI systems in recruiting – both sourcing and assessing applications – fall into the high-risk category. Providers and deployers must implement risk management, ensure data governance, maintain technical documentation, enable human oversight and guarantee accuracy, robustness and cyber security. Conformity assessments and registration are also required.

For candidates this means stronger rights to information, explanation and human review. Anyone receiving a negative decision through an AI system is entitled to a transparent justification. Pure black-box models are not permissible in high-risk recruiting.
